Every paper cup used in a cafe, cloud kitchen, or coffee delivery operation in India is a regulated food contact material. Most cafe operators are unaware of the specific compliance requirements that apply to paper cups — particularly the lining specification, which is the single most important compliance variable in hot beverage packaging. A standard PLA-lined cup served with coffee at 75°C is not just a performance failure; it is a potential FSSAI compliance issue. The FSSAI Framework for Paper Coffee Cups
The Food Safety and Standards Authority of India (FSSAI) regulates food contact packaging under the Food Safety and Standards (Packaging) Regulations, 2018. Paper cups used for hot beverages fall squarely within this framework — the cup body, the inner lining, the lid, and any printed ink on the exterior are all food contact materials subject to FSSAI compliance requirements.
The core FSSAI requirement is that no food contact material may transfer harmful substances to the food or beverage at the temperatures and conditions of use. For hot coffee service, the relevant temperature range is 65–85°C. This temperature requirement is what makes the lining specification the critical compliance variable.
The Lining: The Most Important Compliance Variable
A paper cup without a lining is not waterproof. The inner lining is what prevents the hot beverage from penetrating the paperboard, softening the cup, and potentially transferring paperboard fibres and chemical compounds into the beverage. The lining must be food-safe at the service temperature — and this is where most compliance failures occur.
PE (Polyethylene) Lining — The Conventional Standard
PE lining is the conventional standard for paper cups globally and in India. Polyethylene is food-safe at temperatures up to 100°C, making it fully compliant for all hot coffee applications. PE-lined cups are the most widely available, most cost-effective, and most operationally reliable option for high-volume cafe and cloud kitchen operations.
PE lining is not compostable — the PE layer prevents the cup from breaking down in composting conditions. This is the primary environmental limitation of PE-lined cups, and it is driving the shift towards PLA-lined alternatives in the specialty coffee market.
Standard PLA (Polylactic Acid) Lining — Not Suitable for Hot Coffee
Standard PLA lining is derived from plant starch (typically corn or sugarcane) and is marketed as a compostable alternative to PE. However, standard PLA has a heat deflection temperature of approximately 55–60°C. At temperatures above this threshold, the PLA lining softens, loses its waterproofing integrity, and can allow the beverage to penetrate the paperboard.
This means that a standard PLA-lined cup used for hot coffee service at 70–80°C is both a performance failure (the cup may leak or deform) and a potential FSSAI compliance issue (the softened lining may transfer compounds into the beverage). Standard PLA-lined cups are appropriate for cold beverages only — iced coffee, cold brew, and ambient-temperature drinks.
C-PLA (Crystallised PLA) Lining — The Correct Compostable Specification for Hot Coffee
C-PLA is a heat-stabilised form of PLA produced through a crystallisation process that raises the heat deflection temperature to approximately 85–90°C. C-PLA-lined cups are food-safe at hot coffee service temperatures and are genuinely compostable under industrial composting conditions (ISO 17088 certified).
C-PLA cups are the correct specification for cafes that want to offer compostable hot beverage packaging. They are more expensive than PE-lined cups and require industrial composting infrastructure to break down — they will not compost in a home compost bin or landfill. But for FSSAI compliance at hot coffee temperatures, C-PLA is the only compostable lining that meets the specification.

SUP Ban Compliance for Coffee Service
India's Single-Use Plastic ban, implemented under the Plastic Waste Management Rules, prohibits several items that are standard in coffee service operations. For cafe and cloud kitchen operators, the prohibited items are: plastic stirrers, plastic straws, plastic carry bags below 75 microns, and expanded polystyrene (thermocol) cups.
Plastic stirrers: Prohibited since July 2022. Replace with birchwood stirrers (the most widely available SUP-compliant alternative) or bamboo stirrers. Birchwood stirrers are food-safe, biodegradable, and available in standard coffee stirrer dimensions (14cm and 18cm).
Plastic straws: Prohibited. Replace with paper straws for delivery and takeaway. For dine-in, bamboo or stainless steel straws are reusable alternatives. Paper straws should be individually wrapped for hygiene compliance.
Polystyrene cups: Prohibited. Any operation still using expanded polystyrene (thermocol) cups is operating with prohibited packaging. Replace with PE-lined or C-PLA-lined paper cups.
Plastic carry bags below 75 microns: Prohibited. Replace with kraft paper carry bags (100–120 GSM) for takeaway and delivery orders.
Note: PE-lined paper cups are not prohibited under the current SUP ban. The PE lining is a thin coating applied to the paperboard, not a standalone single-use plastic item. PE-lined paper cups remain fully legal and FSSAI-compliant for hot coffee service.
Food-Safe Ink for Custom-Printed Coffee Cups
If you are sourcing custom-branded paper cups — with your cafe logo, brand colours, or promotional messaging — the inks used in printing must be food-grade. Standard commercial printing inks contain chemical solvents and pigments that are not food-safe and can migrate through the paperboard when exposed to the heat and moisture of hot coffee service.
For hot coffee cups specifically, the combination of 70–80°C service temperature and condensation on the exterior creates conditions where ink migration through the paperboard to the beverage is a real risk. Ask your supplier whether the inks are water-based or soy-based, and whether they comply with FSSAI food contact regulations. Ask for the ink safety data sheet. A supplier who cannot provide ink safety documentation is not a compliant food packaging supplier.
GST ITC Recovery on Paper Cup Procurement
Paper cups fall under HSN Chapter 48 (paper and paperboard articles). If your cafe or cloud kitchen operates under the regular 18% GST scheme, you can claim 18% Input Tax Credit on paper cup purchases — but only if your supplier issues a compliant B2B e-invoice with HSN Chapter 48 classification.
